Understanding the Buyer Representation Agreement
California requires buyers to sign a Buyer Representation and Brokerage Contract before touring a home. Here's what it says, why it exists, and what it means for you — in plain language.
- California law requires a signed BRBC before any property tour — and no later than when a buyer submits an offer.
- The BRBC defines your agent's services, the representation period (maximum three months), and how compensation works.
- Compensation is fully negotiable. There is no standard rate — the form itself says so.
- The agreement can be sole-agent or open — whether you can work with other agents depends on which option is selected.

What is the BRBC?
The BRBC (Buyer Representation and Brokerage Contract) is California's standard buyer representation agreement, published by the California Association of REALTORS®. It's a contract between you and your agent's brokerage that establishes your agent is working for you — not the seller — and spells out the terms of that relationship before any home is toured.
Signing it does not commit you to buying any property. It formalizes the working relationship so both sides know what to expect.
What am I actually agreeing to?
Representation period — maximum three months
California law caps the term at three months. The agreement shows a start and end date — confirm they match what you discussed. If you're still searching when it expires, you'll sign a new one.
Sole-agent or open arrangement
A sole-agent agreement means you're working exclusively with this broker for the scope and period described. An open arrangement lets you work with other agents. Which applies depends on what's selected and initialed — confirm this before you sign.
Geographic and property scope
The agreement describes where and what you're searching for. If you're looking in multiple areas — say, Twain Harte and Sonora — both should be included. Scope can be amended by mutual agreement if your search changes.
Compensation — fully negotiable
The BRBC states that who pays and how much is a matter of agreement between the parties — there is no standard rate set by law. The agreed amount is the maximum your broker may receive from any source, so if a seller offers compensation, it applies toward that amount rather than stacking on top.
Services and termination
The agreement spells out what your agent will do for you, and how either party can end the agreement. Read the termination provisions before signing so you understand the process if circumstances change.
How does this protect me?
Once signed, your agent has enforceable fiduciary duties to you:
Your interests come first
Your agent is legally required to put your interests ahead of their own and the seller's — and cannot negotiate in a way that benefits the seller at your expense.
Your information stays confidential
Your budget ceiling, timeline, and motivation to buy stay between you and your agent. They cannot share any of it with the seller or listing agent.
No surprises on compensation
Full disclosure of what your agent earns is built into the form. If there's a gap between what a seller offers and what was agreed, you'll know before you're under contract — not at the closing table.
Why I send it before the first showing
California law requires the BRBC before any tour — so legally, it has to exist before we walk through a door together. But there's a practical reason I send it even earlier: when you're standing in front of a property you love, you're not in the best headspace to carefully read a contract.
Sending it early gives you time to review the representation period, confirm the agent arrangement, ask questions about compensation, and understand the termination provisions — without the pressure of a showing or a pending offer. Since sellers are no longer required to offer buyer-agent compensation and those amounts are no longer on the MLS, it's especially important to have that conversation before we start, not after you've found something you want.

Questions buyers ask
Does signing mean I have to buy a house?
No. The BRBC is not a purchase contract. It defines the working relationship and how compensation works if a transaction closes. You're agreeing to work with this agent — not to buy any specific property.
Is this a sole-agent agreement, or can I work with other agents?
It depends on what's selected in the form. A sole-agent agreement means you've agreed to work with this broker for the scope and period described. An open arrangement lets you retain the right to work with others. Confirm which option applies before you sign.
Do I have to pay my agent out of pocket?
In many transactions, the seller agrees to cover buyer-agent compensation — but since 2024, this is negotiated deal by deal, not assumed. If the seller covers it, it applies toward the agreed amount in your BRBC. If they don't, we'll talk through your options before you're under contract. No surprises.
Can I negotiate the terms?
Yes. The duration, scope, and compensation are all negotiable. The BRBC itself states that broker fees are not set by law. Ask about anything that doesn't feel right — a good agent would rather adjust the agreement than have you sign something you don't understand.
What if the relationship isn't working?
The BRBC includes termination provisions describing how either party can end the agreement. Review that language before signing so you know the process if you ever need it.
What if I find a home on my own — like a FSBO?
The BRBC typically covers any property you purchase during the agreement period within the defined scope, including for-sale-by-owner homes. Worth discussing upfront if you're actively searching on your own as well.
